(2015) Shen Qian Fa Zhi Zi No. 40
Peng Qinglin and Xie Lifang:
As to the case of dispute over loan contract between the enforcement applicant Chen Zeling and the person subject to enforcement Peng Qinglin and Xie Lifang, the Ruling of (2015) Shen Qian Fa Zhi Zi No. 40 has legally taken effect. As the person subject to enforcement failed to perform the obligations specified in the effective legal instrument, the enforcement applicant Chen Zeling applied before this court for enforcement on August 28, 2015, which cannot be directly delivered since your whereabouts is unknown, and therefore this court hereby delivers the following legal instrument by announcement:
1. The Enforcement Order of (2015) Shen Qian Fa Zhi Zi No. 40. Main content: This court orders the person subject to enforcement to perform the obligations specified in the effective legal instrument within five (5) days from the date of delivery of this Order and assume double debt and interest incurred during the period of performance delay, the execution fees and other relevant fees, failing which this court shall enforce the same according to law.
2. The Ruling of (2015) Shen Qian Fa Zhi Zi No. 40. Main content:
(1) In the event that the person subject to enforcement Peng Qinglin and Xie Lifang fails to perform within the designated term, it shall, within five (5) days from the expiration date of the term, truthfully declare its current information of assets and that of the previous year of the date of receipt of the Ruling, and fill out the financial disclosure form and submit the same to this court.
In case that the person subject to enforcement refuses to declare or make false declaration, this court shall impose a fine or detention on the persons liable in accordance with the seriousness of the circumstances.
(2) Seal up, freeze or transfer the person subject to enforcement Peng Qinglin and Xie Lifang (within the limit of RMB 1,107,395 and the liquidated damages, processing fee of this case, debt and interest incurred during the period of performance delay, execution application fees and the actual expenses incurred during the execution).
(3) Auction or sell off the property of the person subject to enforcement Peng Qinglin and Xie Lifang to pay off the debts. This announcement shall be deemed as delivered sixty (60) days after the date of issuance.
